Probate

What is probate?

Generally, probate is the legal process involving identifying and collecting a decedent's assets, liquidating assets to pay liabilities, paying necessary taxes, and distributing property to the heirs and beneficiaries of the estate. Probate is governed by the laws of the state where the deceased resided. The process begins by opening an estate with the Clerk of Court in the county where the decedent lived.

If the decedent has a Will, the Will must be presented to the Clerk of Court. In North Carolina, your Will must be probated in order to pass your property to the intended beneficiaries.
